1. How to
Enter: The Lexus Web Site Sweepstakes (“Sweepstakes”) begins on or
about June 2, 2008 and ends on July 7, 2008 at 11:59 p.m. or when a maximum of
775 completed Internet surveys (“Surveys”) have been received (“Sweepstakes
Period”). All times stated herein are
defined by Pacific Standard Time. To
enter, access the Survey by clicking on the website intercept link on on www.kbb.com, clublexus.com or lexusownersclub.com invitation
from June 2, 2008 to June 7, 2008, 11:59 p.m. or until a maximum of 775 surveys
have been completed. Then, complete (and
thereafter submit) the Survey. Upon
successfully completing and submitting the Survey, you will be entered into the
Sweepstakes (“Survey Entry”). In
addition to answering the Survey questions, you will be required to provide the
following information to enter the Sweepstakes: your name, mailing address
(including zip code), and email address.
Only persons meeting the eligibility requirements listed below who
receive access to the Survey by website Intercept from
kbb.com, clublexus.com or lexusownersclub.com can complete the Survey and enter
the Sweepstakes via the Internet.
Completed Surveys must be received no later than 11:59 p.m. on July 7,
2008, but only 775 Survey Entries will be accepted. Limit
one (1) Survey Entry per person for the entire Sweepstakes Period. Survey Entries in excess of the stated limit
in these Official Rules by the same person will be disqualified. To enter the Sweepstakes without completing
the Survey, legibly hand-print your name, mailing address (including zip code),
telephone number (including area code) and date of birth on a postcard (no
larger than 5”x7”) or on a piece of paper enclosed in a business size (#10)
envelope, and mail, with proper postage affixed, to: Lexus Web Site
Sweepstakes, 1158 26th Street #501, Santa Monica, CA 90403 (“Mail
Entry”). Only one (1) Mail Entry allowed
per separate outer envelope. Mail
Entries must be mailed separately,
postmarked by July 7, 2008 and received by July 14, 2008. No
copies, facsimiles or reproductions of Mail Entries will be accepted. All required entry information for
each method of entry must be completed in full.
Any other attempted form of entry into the Sweepstakes is void.
2. Eligibility: This Sweepstakes is only open to legal residents of
the 50 states of the United States and D.C. (excluding Guam, Puerto Rico, and
all other U.S. territories and possessions), who are physically located and
residing therein and who are 18 years of age or older as of June 2, 2008. Employees of, members of the immediate
families (spouses, children, siblings, parents) of, and/or persons living in
the same household as such persons, whether related or not, of Toyota Motor
Sales, U.S.A., Inc., Global Market Insite, Inc.,
MindClick Group, Inc., The Arthur Group, LLC., Sweepstakes Administrator
(defined below), those involved in the development, production, implementation
and distribution of Sweepstakes and Survey, their advertising or promotion
agencies, parent companies, agents, officers, subsidiaries or affiliates, prize
suppliers, and/or any other persons or entities directly associated with
Sweepstakes (collectively “Sweepstakes Entities”) are ineligible to enter the
Sweepstakes.
3. PRIZES/ODDS
OF WINNING: One (1) of Three (3) $1,000 Cash Prizes. Odds of winning a prize depend on the
number of eligible Survey and Mail Entries received. Limit of one (1) prize per person/family/household. Winners
are solely responsible for all costs, incidentals, and any other expenses not
specifically mentioned as being included.

4. Drawing
and Notification: Potential
winners will be randomly selected in a drawing on or about July 31, 2008, from
among all eligible Survey and Mail Entries received by Sweepstakes
Administrator, an independent judging organization. Each potential winner will
be notified by email within approximately two (2) weeks of the drawing
date. If potential winner is
notified by email, potential winner will have seven (7) days within which to
respond to the prize notification email, or his/her entry will be disqualified,
his/her prize forfeited and an alternate potential winner will be selected. If an entrant changes his/her email address
after he/she enters the Sweepstakes, it is his/her sole responsibility to
notify the Sponsor by (postal) mailing notice to the Sweepstakes Administrator
address (listed below) to be received by the end of the Sweepstakes
Period. If a potential winner cannot be
reached after a reasonable effort has been exerted, if he/she is found to be
ineligible, if he/she cannot or does not comply with these Official Rules, or if
his/her prize or prize notification is returned as undeliverable, potential
winner will be disqualified and an alternate potential winner will be selected
at Sponsor’s sole discretion. Prizes
will be shipped 4 – 8 weeks after winners have been selected and notified.
5. General
Conditions: Sweepstakes is subject to these Official
Rules and all federal, state and local laws (collectively “Rules and
Laws”). If winner is from a jurisdiction
that deems him/her to be a minor, prize will be awarded in the name of his/her
parent/legal guardian. Once submitted,
Survey and Mail Entries become the sole property of Sponsor and will not be
returned. Entrant unconditionally
assigns and transfers to Sponsor all rights, title, interest, and claim, which
he or she now has, or may in the future have to his/her Survey. Information
provided in the Survey will be used for research purposes only, unless entrant
is selected as the winner and is included on the Winners List (described
below). By submitting Survey, entrant confirms
accuracy and veracity of the statements and information contained therein. Any
person attempting to defraud or in any way tamper with this Sweepstakes will be
ineligible for prizes and is subject to prosecution to the full extent of the
law. If, for any reason,
Sweepstakes is not capable of running as originally planned, Sponsor at its
sole discretion, reserves the right to cancel, suspend or modify Sweepstakes or
any portion(s) thereof and conduct the drawing from all salvageable eligible
entries, if any. In the event of a dispute as to the identity of a particular entrant
who submitted a winning Survey Entry, the registered email account holder may,
at Sponsor’s sole discretion, be declared the entrant.
6. Disclaimers: Sweepstakes
Entities are not responsible or liable for multiple entries, entries that are
entered by other than human means (such as by an automated computer program or
any non-human mechanism, entity, or device), or for entries that are illegible,
late, mutilated, tampered with, forged, postage-due, incomplete, misdirected,
lost, misplaced, stolen, destroyed, or otherwise not in compliance with these
Official Rules and such entries will be disqualified. By entering Sweepstakes, entrants agree and
acknowledge to be bound by these Rules and Laws, as well as the decisions of
Sweepstakes Administrator which are final and binding in all respects; to waive
any rights to claim ambiguity with the Official Rules and Laws that Sweepstakes
Entities, their partnerships, subsidiaries and affiliates and each of
such entities’ respective officers, directors, agents and employees shall have no responsibility or liability
(including, but not limited to, liability for any property loss, damage,
illness, personal injury, death, or litigation) in connection with:
participation in this Sweepstakes; human error, acceptance/possession, use,
misuse, or defect of the prizes awarded herein; incorrect or inaccurate
transcription of entry information; any technical malfunctions of the telephone
network, computer online system, computer dating mechanism, computer equipment,
software, internet service provider; interruption or inability to access
Sweepstakes or any online service via the internet due to hardware or software
compatibility problems; any damage to entrant’s (or any third person’s)
computer and/or its contents related to or resulting from any part of this
Sweepstakes; any lost/delayed data transmissions, omissions, interruptions,
defects, or elements of Sweepstakes and/or any other errors or malfunctions
even if caused by the negligence of one of the Sweepstakes Entities. Entrants further acknowledge that said
Sweepstakes Entities have neither made nor are in any manner responsible or liable
for any warranty, representation or guarantee, express or implied, in fact or
in law, relative to any prize, including express warranties (if any) provided
exclusively by a prize supplier that are sent along with a prize.
